Disclaimer: The Brantford Traffic Club and its members, officers, employees, guests, invitees, volunteers,agents,representatives or any other person or related party acting in conjunction with, or on behalf of , or for the benefit of the club or other afore mentioned persons or parties, while operating and carrying on the functions and activities of the Club, including but not restricted to any social, educational or other events, are not liable and expressly disclaim any liability for any damages whatsoever and howsoever caused and including , but not limited to , damages, whether caused by negligence, gross negligence or arising from misrepresentation or gross misrepresentation or failure to perform any duty  or act required by any statute or law or whether arising from a tortuous act or breach of contract, and including , but not limited to any indirect, special, incidental, or consequential damages ( including, but not limited to, damages for loss of business, loss of profits or investments , or the like) whether based on breach of contract, breach of warranty, tort ( including negligence), product liability or otherwise, and this exclusion of liability shall operate to the maximum extent permitted by law and shall be governed by the laws of the Province of Ontario. Any party or person, whether related to or a member, director or officer of the Club or not, expressly acknowledges the Club is a non-profit organization and would not be able to and would not have provided its services, or sponsored its events, for the benefit of third parties and members without this exclusion of liability and all persons or parties, whether members of the Club or not, acknowledge and agree that in consideration of attending Club events, activities, functions , or otherwise receiving or benefiting from Club materials, services or information and whether such parties paid for the fore going or not, expressly agree this disclaimer and exclusion of liability applies to them, and is a fundamental element of the basis of the relationship between the Club and or other foregoing person or persons and such party or person.
